Welcome to Divine Grace Coaching! By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please refrain from using our site or services.
1. Purpose of Services
Our website and coaching services are intended to provide faith-based guidance, encouragement, and support for couples seeking to strengthen their marriages, engaged couples preparing for marriage, and individuals seeking personal growth. Our services are not a substitute for medical advice, mental health therapy, licensed counseling, or other professional services.
2. Use of Website Content
All materials, including text, graphics, logos, and images, on this site are the property of Divine Grace Coaching and are protected by copyright laws. You may not reproduce, distribute, or use any content for commercial purposes without prior written permission.
3. Coaching Disclaimer
- Coaching is not therapy, counseling, or medical treatment. Coaching sessions are intended for personal growth, spiritual development, and relationship enhancement.
- We are certified Christian life coaches, not licensed marriage and family therapists (LMFT), licensed professional counselors (LPC), or medical professionals.
- Coaching is not marriage therapy or couples counseling. We provide faith-based coaching focused on goals, growth, and biblical principles.
- Results are not guaranteed and vary by individual and couple. Success depends on client effort, commitment, and participation.
- Clients experiencing severe marital crisis, domestic violence, substance abuse, suicidal thoughts, or mental health emergencies should seek appropriate licensed professionals immediately.
- Both partners in couples coaching must consent to participate.
- For medical, legal, financial, or mental health advice, please consult appropriate licensed professionals.
4. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
5. Payments and Refunds
Payment Terms:
- Payment is due at time of booking or according to the agreed-upon payment plan schedule.
- Payment plans must be completed on the agreed schedule (30-day or 60-day intervals as specified).
- Failure to complete payment plan installments may result in suspension of services until payment is received.
- Clients are responsible for all agreed-upon payments, even if they choose to discontinue services.
- Payment methods accepted include credit card, debit card, and other methods as offered through our payment processor (Stripe).
Refund Policy:
- Full refund available if requested before the first coaching session is completed.
- No refunds after the first coaching session has been completed.
- Package sessions are non-refundable and non-transferable once the program has begun (after first session).
- Payment plan installments are non-refundable once the program has begun.
- Unused sessions in packages cannot be refunded, transferred, or rolled over to future programs.
- Refunds, when applicable, are processed within 7-10 business days to the original payment method.
Cancellation and Rescheduling Policy:
- Clients must provide at least 48 hours advance notice to cancel or reschedule a scheduled session.
- Cancellations with less than 48 hours notice may result in forfeiture of that session with no makeup session provided.
- No-shows (missed sessions without any notice) will forfeit that session with no refund or makeup session.
- Emergency exceptions may be considered at the sole discretion of Divine Grace Coaching.
- Divine Grace Coaching reserves the right to reschedule sessions due to emergencies, illness, or unforeseen circumstances. Reasonable notice will be provided, and makeup sessions will be scheduled.
6. Confidentiality
- Divine Grace Coaching maintains strict confidentiality of all client information and communications.
- Information shared in coaching sessions will not be disclosed to third parties without written client consent.
Exceptions to Confidentiality:
Confidentiality may be broken in the following circumstances:
- Legal requirements, including court orders and subpoenas
- Situations involving imminent harm to self or others
- Suspected child abuse, elder abuse, or dependent adult abuse (mandatory reporting required by law)
- With client's written permission for testimonials, case studies, or marketing materials (names and identifying details will be changed or used only with explicit consent)
For Couples Coaching:
- Both partners acknowledge that information shared by one partner may be discussed in joint coaching sessions unless otherwise specified and agreed upon in advance.
- Coaches will not keep secrets between partners that are relevant to the coaching process.
7. Client Responsibilities
Clients are expected to:
- Approach coaching sessions with honesty, openness, and a willingness to engage in the process.
- Commit to completing any action steps, assignments, or reflections discussed during sessions.
- Understand that success and positive outcomes depend on their active participation, effort, and follow-through.
- Attend all scheduled sessions on time or provide appropriate notice for cancellations.
- Treat coaches with respect and maintain appropriate professional boundaries.
- Inform coaches of any safety concerns, domestic violence situations, legal issues, or mental health crises.
For Couples Coaching:
- Both partners must attend all scheduled sessions unless otherwise agreed upon in advance.
- Both partners commit to respectful communication during sessions.
- Both partners agree to maintain confidentiality about what is shared in coaching sessions.
- Both partners acknowledge they are participating voluntarily and consent to the coaching process.
8. Termination of Services
Either party may terminate the coaching relationship at any time.
Client-Initiated Termination:
- Clients may discontinue services at any time by providing written notice.
- No refunds will be issued for unused sessions in packages (per refund policy in Section 5).
- Payment plan obligations remain in effect even if services are discontinued, unless otherwise agreed in writing.
Coach-Initiated Termination:
Divine Grace Coaching reserves the right to terminate the coaching relationship for the following reasons:
- Non-payment or failure to honor payment plan agreements
- Disrespectful, abusive, threatening, or inappropriate behavior toward coaches
- Client needs exceed the scope of coaching services (referral to licensed professional will be provided)
- Lack of client engagement, repeated no-shows, or failure to complete assignments
- Any situation where coaches determine they cannot effectively serve the client or the coaching relationship is not productive
- Safety concerns for coaches or others
In cases of coach-initiated termination, prorated refunds for unused sessions may be issued at the sole discretion of Divine Grace Coaching.
9. Limitations of Liability
- Divine Grace Coaching and its coaches, employees, contractors, and affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use of our services, website, or any materials provided.
- This includes, but is not limited to, personal, financial, emotional, relational, or physical outcomes.
- Coaching results depend on client effort, commitment, implementation, and circumstances beyond our control.
- Results are not guaranteed. Every individual and couple's situation is unique, and outcomes will vary.
- Our total liability to any client shall not exceed the total amount paid by that client for services.
- We are not responsible for decisions clients make based on coaching conversations, advice, or guidance provided.
- Clients assume full responsibility for their choices and actions.
10. Indemnification
By using our website and services, you agree to indemnify, defend, and hold harmless Divine Grace Coaching, its owners, coaches, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) resulting from:
- Your use of the website or services
- Your breach of these Terms and Conditions
- Your violation of any law or the rights of any third party
- Any content you submit or transmit through our services
11. Third-Party Links
Our website may contain links to third-party websites, resources, or services. We are not responsible for the content, accuracy, practices, policies, or availability of these external websites. The inclusion of any link does not imply endorsement by Divine Grace Coaching. You access third-party sites at your own risk.
12. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or our services:
- Informal Resolution: Parties agree to first attempt to resolve disputes through good-faith negotiation and communication.
- Mediation: If informal resolution is unsuccessful, parties agree to attempt resolution through mediation before pursuing legal action.
- Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
- Jurisdiction: Any legal disputes arising from these terms shall be resolved exclusively in the courts of Ellis County, Texas (or your county), and both parties consent to the jurisdiction of such courts.
13. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any other written agreements, constitute the entire agreement between you and Divine Grace Coaching regarding the use of our services and supersede any prior agreements or understandings.
15. Changes to Terms and Conditions
We reserve the right to update, modify, or revise these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting to our website. The "Effective Date" at the top of this document will reflect the date of the most recent update. Continued use of the website or services after changes have been made indicates your acceptance of the new terms. We encourage you to review these terms periodically.
